Terms and Conditions

Promoter

Entrants

Any person who enters a competition through the promotor’s website or through the postal entry model set out at clause 5.7 below. You understand that prize draws with a qualifying question are not considered gambling and are not regulated by the gambling commission,

General

2.1 By entering a competition, entrants are deemed to have read, understood and accepted all Terms and Conditions as set out herein.

2.2 Competitions are governed by English law.  Entrants are solely responsible for ensuring that by entering a Competition, they are not in breach of any law in the country which they reside.  The promoter will not be held responsible for an Entrant participating in a Competition unlawfully.

2.3 All Competitions are skill-based Competitions.

2.4 All entry fee is payable for each entry to a Competition. A free entry mode is also available and details are set out in clause 5.7 below. Postal entries are limited to one per person and dwelling and one per competition.

2.5 Upon entering a Competition, Entrants must submit all contact details as requested by the promotor. Entrants will be allocated with ticket numbers between 1 and the maximum allowed on the Competition they enter.

2.6 It is the Entrant’s responsibility to ensure that all contact details provided to the Promoter are correct.

2.7 The Promotor is not responsible for any failure to contact the Entrant due to incorrect information being provided by the Entrant.

2.8 Entrants agree that should they win a prize, they will take part and co-operate fully with all reasonable publicity and promotion as requested by the Promotor.

2.9 Entrants agree that should they win a prize, the Promotor can disclose their surname and Country of residence.

2.10 Should any clause contained within these Terms and Conditions be determined illegal, invalid or otherwise unenforceable then that clause shall be deleted from these Terms and Conditions and the remaining clauses shall remain in full force and effect.

2.11 The Promotor reserves the right to hold, void, suspended, extend, cancel or amend the Competition where becomes necessary to do so.

2.12 A maximum of 1 extension will take place, in the event of a non-sell out draw. At least 70% of the ticket allocation must be taken up before the draw can be made.

Eligibility

3.1 The Competition is open to all residents in the UK and Ireland aged 18 and over except:

  • Employees of the Promotor and their immediate families (spouse, parent, child, sibling, grandparent or step-family).
  • Any person professionally connected with the Promotor in any way or their immediate family.

3.2 By entering the Competition, Entrants are confirming that they are eligible to enter the Competition. The Promotor can request proof of eligibility of any Entrant at the time. If an Entrant fails to provide the necessary proof of eligibility, the Promotor reserves the right to disqualify an Entrant from the Competition.

3.3 The Promotor will not accept entries that are incomplete.

3.4 The Promotor reserves the right to disqualify any Entrant if it has reasonable grounds to believe that the Entrant has breached any of these Terms and Conditions or acted in any way which is considered by the Promotor to be illegal.

3.5 No refunds will be provided to the Entrant where the Entrant is found to be ineligible, disqualified for any reason or where an entry is incomplete.

Competition

4.1 Upon entry to the Competition, Entrants acknowledge that payment of an entry fee and providing a correct answer to the entry question does not guarantee that they will win a prize.

4.2 The Promotor does not guarantee the value of the prize or the condition of the prize at the time it will be given to the winner, the Promotor will however try to provide a clear and accurate description of each prize.

4.3 Only entries completed in full that contain the correct answer as held by the Promotor will be entered into the Competition.

4.4 Once the maximum number of entries are received for a Competition or the closing date is reached, the Competition will close.

4.5 All entries to the Competition become the property of the Promotor and will not be returned except in cases where the Promotor cancels the Competition.

4.6 The Promotor’s decision is final and no correspondence will be entered into about the result of the Competition following the selection of the winner.

4.7 Entrants acknowledge that the Consumer Protection (Distant Selling) Regulations 2000 does not apply to this Competition.

4.8 The draw will be shown live on our Facebook channel.  The winning number will be draw by Google random number generator and the winner will announced live. The Competition will close at 7pm on a selected date shown on the website. The draw will take place on the same day as the competition closes at 8pm live on our Facebook channel

If the Entrant is not able to collect the prize because of any unforeseen circumstances we will send the prize by Malca-Amit. The winner will have to show their photographic identification and proof of their address.

Entry

5.1 In correctly answering the entry question to a Competition, the Entrant acknowledges that they have exercised their skill, knowledge and judgment.

5.2 A maximum of 20 entries is permitted by any individual Entrant per Competition.

5.3 To complete an entry, an Entrant will be asked to provide their full contact details (name, address, date of birth, email address and telephone number). The Entrant will be required to make a credit or debit card payment to the Promotor for the entry fee. Once the form is submitted, the Entrants card payment will be processed.

5.4 The Competition will run from and including the opening date to the closing date detailed on the Promotors website or until the maximum number of entries are received by the Promotor for a Competition.

5.5 If necessary, the Promotor reserves the right to change the opening and closing dates. The Promotor will update the website of any such changes as soon as reasonably possible.

5.6 All Competitions entries must be received by the Promotor no later than the date and time specified on the Promotor’s website in relation to the particular Competition.  All entries received after the closing date are automatically disqualified and no refunds are provided by the Promoter.

5.7 A free entry mode is also available to Entrants by sending unenclosed postcard to the promotor via first class post stating the following:

  • Entrants Name
  • Entrants Address
  • Entrants Date of Birth
  • Entrants Telephone Number
  • Entrants Email Address
  • Name of Desired Competition
  • Correct Answer for the Competition skilled question

Postal entries are limited to one Competition entry per Entrant. All entries must be received by the Promotor before the closing date for the Competition and should be received by the Promotor before the closing date for the Competition and should be posted by first class post to Diamond Games Cardiff Ltd, JR Quarter, Moy Road Industrial Estate, Taffs Well, Cardiff, Wales CF15 7QR.  All postal entries received after the closing date are void and will not be entered into the Competition

All postal entries with the incorrect answer will not be entered into the Competition.

Closing the Competition and selecting the winner.

6.1 If at the closing date of the Competition, the Promotor at their sole discretion can:

  • Close the Competition and award the prize to the winner.
  • Close the Competition and award the remaining funds as a cash prize to the winner after the deduction of any transaction and marketing fees.

6.2 In the event of a prize being awarded to an Entrant under clause 6.1 the Promotor will be entitled to retain 30% of the entry fees as an administration charge.  The remaining balance less any marketing and promotional fees will them be the cash prize referred to in clause 6.1b. the Promotor will contact the winning entrant as soon as reasonably possible after the Competition draw via the contact details provided by the Entrant.  The winning Entrant must then accept the prize.  If the winning Entrant cannot be contacted by the Promotor by any of the contact details provided by the Entrant within 7 days of the Competition draw, the Promotor reserves the right to select an alternative winner who in turn will have 7 days to accept the prize. The original winning Entrant will have no claim over the Competition prize after the alternative winner is selected.

6.4 The Promotor will provide full details on its website of when the draw for a Competition will take place.

6.5 The Promotor will make available the Surname and Country of the winners of all Competitions if requested by any Entrant to that Competition.  This information can be obtained by sending a written request to the Promotor within one month from the date of the Competition draw.

6.6The winning Entrant must claim the prize personally and must provide proof of identity on the request of the Promotor.

Limitation of Liability

71.The Promotor makes no representation or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for the liability for death or personal injury caused by the negligence of the Promotor, the Promotor shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promotor, or its servants or agents, in connection with the arrangement for supply or the supply, of any goods by any person to the prize winners and, where applicable to any family/persons accompanying the winners, or in connection with any of the Competitions promoted by the Promotor.

Privacy Notice

8.1 The Entrant acknowledges that the Promotor may use personal data provided by and belonging to the Entrant to facilitate the operation of each Competition according to these Terms and Conditions.

8.2 The Entrant acknowledges that the Promotor may also disclose information to third parties for the prevention of fraud, money laundering, legal or other financial regulatory reasons.
